Since 2021, the Chartered Institute of Arbitrators (Ciarb) has served as the sole provider of arbitration case management services for the Pubs Code Adjudicator (PCA), playing a vital role in supporting fair and independent resolution of disputes between tied pub tenants and pub-owning businesses. 

The PCA acknowledges and appreciates the professionalism and expertise Ciarb has brought to the arbitration process over the past four years. Their oversight has helped to ensure that arbitrators were well-trained in the Pubs Code and that disputes were handled with consistency, impartiality, and respect for tenant rights. 

In light of reduced arbitration numbers and to continue to provide an efficient and cost effective service, the PCA will resume direct management of dispute services, marking a new chapter in the delivery of arbitration under the Pubs Code from 28 November 2025. This change relates to the administrative management of referrals, and not the PCA’s consideration of the appointment of an arbitrator in each case. 

Importantly, there will be a seamless transition, and the PCA is working closely with Ciarb to ensure this happens smoothly, maintaining continuity and quality in the service provided to tenants and pub-owning businesses alike. 

The purpose of arbitration under the Pubs Code remains unchanged: 

  • To offer independent resolution of disputes.
  • To support tenant rights and ensure their voices are heard.
  • To promote the fair and consistent application of the Code. 

The PCA remains committed to upholding these principles and ensuring that all parties continue to benefit from a transparent and effective dispute resolution process.
